May 24, 2023 - Binding Open Season for Empress to TEP (ETT) Transport Service

Bid Window Closes June 7, 2023 at 4:00 p.m. Saskatchewan time

TransGas Limited (TransGas) hereby announces a Binding Open Season for Renewable/Non-renewable Long Term Firm Empress to TransGas Energy Pool (TEP) (ETT) Transport Service. This offer is being conducted pursuant to the terms and conditions contained within the TransGas Comprehensive Tariff and the terms and conditions set out herein. First come, first served volumes will not be available during this Binding Open Season.

To make incremental import receipt capacity available and respond to the current Canadian Mainline Existing Capacity Open Season, TransGas is soliciting requests for new ETT capacity. 

The transportation capacity TC Energy has available, as outlined on their website, does not reflect the takeoff capacity TransGas has off the TCPL Mainline. TransGas requests Customers identify their specific ETT needs so TransGas can understand facility take-off requirements to meet Customer needs.

Customers should consider the following in their response:

  1. Requests for new ETT capacity to commence no earlier than October 1, 2023. Dates after September 30, 2023 will be accepted on any date, as selected by the Customer, and must be identified on the Request Form.  
  2. Longer terms are certain to be given preference based on the TCPL Mainline evaluation process and competing with bids further downstream where tolls are higher. The longer the term, the higher likelihood that TransGas can secure the contract through the Mainline Existing Capacity Open Season. Customer must include desired term. TransGas does not guarantee it will, nor is it obligated to, satisfy all requests for new capacity. The potential success of a bid is directly tied to term length, followed by start date (earlier preferred).
  3. The cost for this service is the R11.0 Long Term Firm Receipt Transportation; current TransGas rates are subject to change. Any ETT transportation contracts awarded with less than a three-year duration will have No Renewal Rights (NRR) and, based on term, may or may not be successfully awarded. Successful ETT bids will be subject to a 26-month shed deadline and have Yearly After Initial Term (YAIT) renewal rights. ETT service will automatically renew for a one-year period unless a Customer provides written notice to terminate at least 26 months before the current term expires. 
  4. TransGas will have the ability to convert this receipt transportation service to Nova Inventory Transfer (NIT) to TEP (NTT) transportation service on the renewal date each year, or prior to the renewal date if mutually agreed. Customers holding ETT Service will need to bid on future NTT service offerings if interested in converting to NTT service; ETT service will not be treated as a queue for future NTT service offerings. Customers must include a minimum and maximum volume requested.
  5. Bids are irrevocable and immediately binding on the Customer upon the close of this Binding Open Season.
  6. Customers responding to the ETT open season, who also responded to TransGas’ February 2023 NIT to TEP open season, will be given the option to indicate whether or not they are interested in accepting ETT service in lieu of the requested NTT service in the event that their existing NTT bid based on volume and/or term is unfulfilled.
  7. A successful bid will only guarantee receipt capacity for gas to a Customer’s TEP account.  For a Customer to have a guarantee that gas is available at a specific Point of Delivery, the Customer must also have an approved delivery contract.  
  8. For preliminary planning purposes, it would be helpful to TransGas if the Customer would indicate the meter code(s), or planned future facility, with corresponding volume that may be associated with the requested incremental increase to NIT to TEP service.  Note this section only is non-binding and will assist TransGas in facility planning.

Additional terms governing this service include:

  1. Service offering is contingent on the ability to acquire third-party transport on TCPL Mainline.
  2. This service offering has the same priority of service as NIT to TEP Service.
  3. Queue deposit is not required.

Upon receipt of bids, all bids will be evaluated and TransGas will package as needed at TransGas’ sole discretion in response to the existing Canadian Mainline Existing Capacity Open Season to avoid adversely impacting TransGas’ System or Customers. These requests are binding on TransGas only if, and when, TransGas can secure TCPL Mainline contracts. Additional conditions will be outlined in the contract.  Upon award of the transport from TCPL Mainline, TransGas will execute the transportation contract with the Customer in the form of an ETT contract in the MyTransGas business system. 

Received requests will be evaluated and awarded based on the following:

  • In the event that total bids exceed current ETT capacity on the TransGas System, TransGas reserves the right to delay the start-date of the ETT service, or prorate the ETT service, until interconnect capacity is expanded to accommodate the requested demand.  
  • Service offering contingent on the ability to secure TCPL Mainline transportation based on the Customer’s term and start date.

TransGas shall notify Customers with initially successful requests no later than ten (10) business days after TCPL Mainline awards the contract(s) through their Open Season. TransGas will enter the new or amended contract terms into MyTransGas on the Customer’s behalf. 

Request Forms must be submitted by 4:00 p.m. Saskatchewan time on Wednesday, June 7, 2023.
